The WomensNet Network Terms of Use


This is the Big Bad Legal Stuff "they" make us post (sorry - it is so not us):

The following rules govern the use of all pages, areas and affiliated websites of
The WomensNet Network, a service and publication of WomensNet.Net/MBS
Solutions (hereinafter 'the Service' or 'The WomensNet Network'. Please read
these rules carefully. Your use of and presence 'in' The WomensNet Network
constitutes your agreement with these rules. If you do not agree with these rules, you will not be able to post to or chat in The WomensNet Network, or access internal pages or afifliated websites of The WomensNet Network.

1) General Provisions:

(a) The WomensNet Network and WomensNet.Net/MBS Solutions do not
endorse, support, sanction, encourage, verify, or agree with the comments,
opinions, or statements posted on bulletin boards, in chat rooms, or otherwise contained in or available through the Service.

(b) Any information or material placed online, including advice and opinions, are the views of those who post the statements, and does not necessarily represent the views of WomensNet.Net/MBS Solutions or The WomensNet Network.

(c) If you are under 18, your parent(s) or guardian(s) must read and agree to this Subscriber Agreement, unless you are an emancipated minor.

(d) Absolutely no bots or clones are to be used on this server; persons found using them will be ejected.

2) Language: Since The WomensNet Network has members of all ages, we do have to insist that language in The WomensNet Network remain PG-13 rated; we can and will remove any bulletin board posts or uploads that contain any obscene, indecent, or offensive language or material that is disruptive, libelous, abusive, harassing, or hateful, constitutes junk mail, name-calling, or unauthorized advertising, invades anyone's privacy, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law or regulation. You agree to use the service only for lawful purposes.

3) Personal Rights: Your right to use the Service is personal to you -- you may
not authorize others to use the Service, and you are responsible for all use of
the Service through your account.

4) Service disruption: You agree not to disrupt or interfere with the Service, nor
to alter or tamper with any information or materials on or associated with the
Service.

5) Chain Letters/Pyramid Schemes/Gifting Programs: Chain letters, pyramid schemes and gifting programs are generally considered illegal, and as such, are not permitted on The WomensNet Network. In the event that a chain letter is not found to be illegal, it will be considered disruptive to the Service, pursuant to Paragraph 4 of this agreement, and as such, the Subscriber distributing the chain letter will have their access to The WomensNet Network terminated.

6) Advertising: You shall not use The WomensNet Network to advertise or
perform any commercial solicitation, including, but not limited to, the solicitation
of users to become subscribers of other online information services competitive
with The WomensNet Network. Participation in specific discussions, forums and
classes that have been designated as advertising events by WomensNet.Net or
it’s Affiliated websites is not a violation of this
Condition.

7) Removal of Bulletin Board Posts: WomensNet.Net/MBS Solutions reserves
the right, but undertakes no duty, to review, edit, move, or delete any material
provided for display or placed on the Service or its bulletin boards, in its sole
discretion.

8) Debate vs. information: The WomensNet Network is intended to provide a
forum for a robust and free-flowing exchange of information, opinions and
comments. Since The WomensNet Network is designed to provide an enjoyable
and informative experience for all participants, unless specifically stated, our
forums are not for "debate" about the validity of the topic in and of itself, but
instead are avenues for the sharing and exchange of information.

9) Identification:

(a) The people you meet in The WomensNet Network are strangers. You are
responsible for guarding your personal information. If you decide to meet
anyone in-person, please use good judgment and common sense. If you do
meet in-person always plan to meet in a public place and, if possible, in a
group setting. If you are under 18, do not meet someone in-person without
your parent or guardian's permission. The WomensNet Network suggests
that you never provide anyone with your full name, phone number, or address.

(b) You may not (i) select or use a Member Name or e-mail address of another
person with the intent to impersonate that person; (ii) select or use a Member
Name or e-mail address which gives the impression that you are a The
WomensNet Network Host; (ii) use a Member Name or e-mail address subject
to the rights of any person, other than your own, without express written
authorization; (iii) use a Member Name in violation of the intellectual property
rights of any person; or (iv) use a Member Name that The WomensNet Network,
in its sole discretion, deems offensive.

10) Intellectual Property:

(a) You are responsible for ensuring that any material you provide to the Service, upload to your profile or Personal Page, or post on a bulletin board or in a chat -- including but not limited to text, photographs, video, and sound -- does not violate the copyright or any other personal or proprietary rights of any third party.


(b) Material on the Service is for your personal use only. The Service contains
copyrighted, trademarked, and other proprietary information. You may not in
any way make commercial or other unauthorized use, by publication, re-
transmission, distribution, or otherwise, of material obtained through the Service,
except as permitted by the Copyright Act or other law, without the express
written consent of WomensNet.Net/MBS Solutions.

(c) Postings to the Service are not private. You grant WomensNet.Net/MBS
Solutions the unrestricted right to use, reproduce, modify, translate, and
distribute any material you post to the Service in any medium (now in existence
or hereafter developed) in both the known and currently unknown universe, for
any purpose, including commercial uses, and to authorize others to do so.

11) DISCLAIMERS, WARRANTIES AND INDEMNIFICATION:
(A) YOU AGREE TO INDEMNIFY THE SERVICE PROVIDER AND ITS
EMPLOYEES, AGENTS, REPRESENTATIVES AND OWNERS, AND TO
HOLD THEM HARMLESS, FROM ANY AND ALL CLAIMS AND LIABILITIES
(INCLUDING ATTORNEYS FEES) WHICH MAY ARISE FROM YOUR
SUBMISSIONS, FROM YOUR UNAUTHORIZED USE OF MATERIAL
OBTAINED THROUGH THE SERVICE, OR FROM YOUR BREACH OF
THESE RULES, OR FROM ANY SUCH ACTS THROUGH YOUR ACCOUNT.
YOU FURTHER AGREE THAT WOMENSNET NETWORK/MBS SOLUTIONS
IS NOT RESPONSIBLE AND SHALL HAVE NO LIABILITY TO YOU, WITH
RESPECT TO ANY MATERIAL POSTED BY OTHERS.

(B) YOU EXPRESSLY AGREE THAT USE OF THE WOMENSNET NETWORK
IS AT YOUR SOLE RISK. NEITHER THE WOMENSNET NETWORK, ITS
OFFICERS, DIRECTORS, EMPLOYEES, AND/OR AGENTS NOR ANY OF
THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT
PROVIDERS OR LICENSORS WARRANT THAT THE WOMENSNET
NETWORK WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY
MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED
FROM USE OF THE WOMENSNET NETWORK, OR AS TO THE ACCURACY
, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR
MERCHANDISE PROVIDED THROUGH THE WOMENSNET NETWORK.

(C) THE WOMENSNET NETWORK IS PROVIDED ON AN "AS IS" BASIS
WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED
WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY
AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION
UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

(D) THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR
INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE,
THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION
OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTUOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. SUBSCRIBER SPECIFICALLY ACKNOWLEDGES THAT WOMENSNET NETWORK/MBS SOLUTIONS IS NOT LIABLE FOR THE
DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER SUBSCRIBERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

(E) IN NO EVENT WILL WOMENSNET NETWORK/MBS SOLUTIONS OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING THE WOMENSNET NETWORK OR THE THE WOMENSNET NETWORK SOFTWARE, WHO IS NOT A SUBSCRIBER, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE WOMENSNET NETWORK. YOU HEREBY ACKNOWLEDGE THAT THE PROVISIONS
OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE WOMENSNET
NETWORK.

(F) IN ADDITION TO THE TERMS SET FORTH ABOVE NEITHER,
WOMENSNET NETWORK/MBS SOLUTIONS NOR ITS OFFICERS,
DIRECTORS, EMPLOYEES, AND/OR AGENTS, INFORMATION PROVIDERS
OR CONTENT PARTNERS SHALL BE LIABLE REGARDLESS OF THE
CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS,
OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF,
THE INFORMATION CONTAINED WITHIN THE WOMENSNET NETWORK,
OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION
THEREOF TO THE USER, OR FOR ANY CLAIMS OR LOSSES ARISING
THEREFROM OR OCCASIONED THEREBY. NONE OF THE FOREGOING
PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES
OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS,
PUNITIVE OR CONSEQUENTIAL DAMAGES. ADDITIONALLY, THERE ARE
NO WARRANTIES AS TO THE RESULTS OBTAINED FROM THE USE OF
THE INFORMATION OR CONTENT OF THE SERVICES.

12) Termination: Either party may terminate this Agreement at any time.
Without limiting the foregoing, WomensNet.Net/MBS Solutions shall have the right to immediately terminate your Account in the event of any conduct by you which WomensNet.Net/MBS Solutions, in its sole discretion, considers to be unacceptable, or in the event of any breach by you of this Agreement. If this agreement is terminated for breach of this Agreement or is otherwise terminated by WomensNet.Net/MBS Solutions, then you will not be able to resubscribe to The WomensNet Network, engage in member activities, or access the service
in any way or for any reason without the express written consent of the WomensNet.Net/MBS Solutions The terms and conditions of this Agreement
will survive any and all terminations.

13) Changed Terms: WomensNet.Net/MBS Solutions shall have the right at any time to change or modify the terms and conditions applicable to your use of The WomensNet Network or to impose new conditions, including, but not limited to, adding fees and charges for use.

14) Indemnification: You agree to defend, indemnify and hold harmless
WomensNet.Net/MBS Solutions, its affiliates, audits, respective directors, officers, employees and agents from and against all claims and expenses including attorneys' fees arising out of your use of The WomensNet Network.

15) Miscellaneous: This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof, and supersedes all previous agreements between the parties. This Agreement shall be construed in accordance with the laws of the State of Ohio and each party consents to jurisdiction and venue in the State of Ohio and County of Ohio. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver
of any preceding or subsequent breach or default.

These policies help keep The WomensNet Network accessible to all of us, and empower us to protect ourselves against harassment and disruption.
